ITCRA, as a Membership Association, is a company limited by guarantee and as such is governed by a Constitution. All Members, on acceptance into the Association commit to being bound by the Constitution, Rules & Guidelines. The most comprehensive Guideline is the Code of Conduct.

The ITCRA Code of Conduct articulates a standard of conduct that ITCRA considers is becoming of ITCRA Members and in the interests of ITCRA. It does so by stating general commitments to ethical and professional practice expected of ITCRA Members and more particularly with regard to three key relationships, namely relationships with:

• Other Members;

• Work seekers; and

• Clients.

As such, conduct on the part of an ITCRA Member that falls short of the standard articulated in the ITCRA Code is likely to be unbecoming of an ITCRA Member and/or prejudicial to the interests of ITCRA. It may therefore result in the imposition of sanctions of the type provided for by the Rules that govern ITCRA.

IMPORTANT NOTE: The ITCRA Code is not intended to operate as a complete statement of every ethical or professional obligation of an ITCRA Member but rather is intended to provide one framework within which the ITCRA Board, ITCRA Members, and members of the public with whom they have dealings, may have confidence that ITCRA Members operate their ICT contract and recruitment businesses in an ethical and professional manner.

 

In determining whether conduct of a Member, which has become the subject of a complaint, is prejudicial to the interests of ITCRA or unbecoming of an ITCRA Member regard must be had to the ITCRA Code and may also be had to any other relevant statement of ethical, moral or legal principle to which effect may lawfully be given.

 

All Members of ITCRA commit to this Code of Conduct as part of their Membership compact and are thereby committed to ensuring that their staff are provided with the appropriate training and development required to uphold the standards of professional practice reflected in it.  

 

ITCRA Code of Conduct and Dispute Resolution Procedures and Grievance Lodgment

 

ITCRA has a set of contractually binding rules which Members must adhere to when a grievance is raised against their company. Grievances can be raised against an ITCRA Member, using the Code of Conduct as a reference, by candidates, clients, ITCRA Members, non Member companies or recruitment professionals.

 

To raise a grievance with ITCRA re a Member’s conduct the following steps need to be undertaken:

 

• Review the ITCRA Code of Conduct and determine which standards of the Code you believe the Member has not upheld.

• Confirm the company is an ITCRA Member by checking the ITCRA Directory.

• Complete the ITCRA Code of Conduct Grievance Lodgment Form as per the instructions

 

ITCRA’s Conduct Committee Manager will then be in contact to discuss the next steps in the process, including whether the grievance will be processed as conduct complaint and /or a dispute, mediation or whether the matter will be declined.

NOTE: ITCRA cannot rule in matters of a contractual nature but can direct Members to a mediation process.
